CLAUSE 1 - NAME
The name of the club shall be the MOANA SURF LIFESAVING CLUB
INCORPORATED and shall consist of all persons who shall become members
and who shall retain membership in accordance with this constitution.
CLAUSE 2 - CLUB COLOURS, UNIFORM AND BADGE
The club colours shall be royal blue and gold and the club cap shall be
royal blue with two (2) parallel gold stripes running lengthwise from
front to back.
The club uniform shall be royal blue and gold with the club badge on the
breast pocket. Only Officers, Life members, Junior members and members
who hold the bronze medallion shall be permitted to wear the Club
uniform. Life members may have an insertion denoting life membership
incorporated in the badge.
The club badge shall consist of a gold reel, line and belt on a royal
blue background. The reel shall have above it an albatross with wings
extended fully and below shall be words MOANA SURF LIFESAVING CLUB INC.
CLAUSE 3 - OBJECTIVES
The objectives of the Club shall be:-
(1) To study and practice the methods of surf life saving as laid down
by the “Australian Council” of the Surf Life Saving Australia.
(2) To minimise the loss of life by drowning and render all possible aid
to those in distress by providing beach patrols as agreed to by
contractual agreement between the Club and the State Centre within the
borders of the beach.
(3) To promote demonstrations and arrange classes of instruction for
members of the public in water safety and resuscitation and so bring
about a widespread and thorough knowledge of the principals which
underlie the art of natation in the surf, and to further promote
generally the interest of surf lifesaving.
(4) To co-operate with the local governing authorities, in taking such
measures as are considered necessary by the Club to ensure the safety of
the beach users.
(5) To purchase, sell, mortgage, rent, improve, exchange, manage,
develop, lease, dispose of, turn to account of or otherwise deal with
all or any part of the property of the Club.
(6) To appoint, define the duties, fix the rate of pay and dismiss any
salaried employee of the Club it deems necessary.
(7) To raise money by subscription or otherwise and make calls on
members and to borrow or raise money upon such terms and conditions and
upon such securities and in such manner as may from time to time be
determined.
(8) To invest and deal with the monies of the Club not immediately
requires upon such securities and in such a manner as may from time to
time be determined.
(9) To organise and conduct competitions and social functions for the
benefit of the Club and its members.
CLAUSE 4 - AFFILIATION
The Club shall affiliate with Surf Life Saving Australia, Surf Life
Saving South Australia Incorporated, and any other organisation that the
Management Committee may from time to time determine.
CLAUSE 5 - DEFINITIONS
In this constitution, unless the context or subject matter shall
otherwise require:-
The letters “S.L.S.A.A” where herein used, shall refer to the Surf Life
Saving Association of Australia, the letters “S.L.S.S.A” where herein
used, shall refer to Surf Life Saving South Australia Incorporated, the
letters “S.L.A” where herein used, shall refer to Surf Life Saving
Australia.
The word “Committee” where herein used by itself, shall refer to the
Management Committee of the Club sitting in session.
The word “Club” where herein used by itself, shall refer to the “Moana
Surf Life Saving Club Incorporated”.
The word “Season” where used herein, shall refer to the period
commencing 1st May in any one year to the 30th April of the succeeding
year.
Any words imparting masculine gender shall include feminine gender and
vice versa.
CLAUSE 6 - TYPE OF MEMBERSHIP
Club membership shall commence on the first (1) day of December each
year and shall conclude on the thirtieth (30) day of November the
succeeding year and consist of the following categories:-
(1) Junior Membership:
Available to any person between the ages of seven (7) and under fourteen
(14) years.
(2) General Membership:
Available to any person over the age of thirteen (13) years. Members
joining in this category and holding the appropriate current Association
awards shall make themselves available for patrol duties as directed by
the committee.
(3) Life Membership:
May be granted to any long serving general member who has rendered
special or distinguished service to Moana Surf Lifesaving Club
Incorporated.
Registered Life members shall have the same voting rights and privileges
of a financial general member, but shall not be required to pay any
membership fee or subscription.
Criteria to be used in consideration for Life Membership will include
but not be limited to:-
a) by his expertise and/or efforts has profoundly assisted the Club in
its operation.
b) has promoted and fostered the objects of the club.
c) has promoted and fostered membership.
d) is highly respected by present and past members for his service to
the club.
e) has maintained continuous financial membership
(4) Honorary Membership:
Members of any surf life saving club affiliated with SLSA or SLSSA or of
any kindred organisation who visit the Club for the purpose of
participation in competitive, instructional or any other activities
relating to surf life saving may be granted Honorary Membership of the
Club for the duration of the visit which is reciprocal.
CLAUSE 7 - CONDUCT OF MEMBERS
Club members shall at all times abide by the constitution and all
rulings made by the Committee. Any member who is charged with misconduct
or a breach of discipline shall be reported to the Disciplinary
Committee. Should such misconduct or breach of discipline be proved, the
member may be expelled, suspended, reprimanded or otherwise penalized.

CLAUSE 9 - MANAGEMENT COMMITTEE
The management of the Club shall be vested in the Management Committee
consisting of the :-

Social Business Coordinator
Junior Division Manager
Under 19 Delegates
Occupation Health & Safety Manager
Should the Junior Division Manager not be able to attend a specific
management committee meeting then such person may appoint a proxy from
his committee to attend such management committee meeting.
The Management Committee shall meet at least once per month, an
attendance of six (6) to form a quorum.
For all matters of appeal seven (7) members shall form a quorum. Vice
President, Club Captain and Secretary may not sit on matters of appeal.
Should a forum not be attained, the meeting shall stand adjourned to a
date to be fixed.
Should any member of the Management Committee absent himself from two
(2) consecutive meetings or a total of three (3) meetings without
reasonable excuse, the seat may then be declared vacant and the
management committee may then elect another member in his stead.
The Management Committee shall have the power to fill any vacancies
occurring during the year.
Should any member of the Management Committee hold more than one (1)
position he shall be entitled to one (1) vote only.
Only Management Committee shall form such ad-hoc sub-committees as
considered necessary for the general running of the Club.
(1) The Management Committee shall have the power to appoint delegates
to represent the Club as necessary.
(2) Each member of the Management Committee shall be mindful of the well
being of all the members of the Club and shall bring suggestions and
concerns from those members to the management committee meetings.
The Management Committee shall cause correct book account to be kept
showing financial affairs of the Club.
CLAUSE 10 - FINANCE, BANKING, PAYMENTS
An official receipt shall be issued for all monies received on behalf of
the Club and such monies shall forthwith be banked in the Clubs name in
such bank(s) as the Committee may from time to time direct.
Payments shall be made by cheque signed by the Treasurer and either the
President or the Secretary.
Accounts payable shall be passed for payments by the Management
Committee, recorded in the minutes and endorsed by the Chairman of the
meeting.
The financial year of the Club shall close on the 30th April each year
and the books shall be subject to audit at that time.
All securities held by the Club and all documents of title relating to
club property shall be lodged with the clubs bankers and the receipts of
any two of the President, Secretary or Treasurer shall be sufficient
discharge for same.
CLAUSE 11 - VOTING
At Annual, Special and General Meetings the following shall be entitled
to vote:-
(1) Life Members
(2) General Members
Any proposition pursuant to these meetings will be deemed carried by 75%
majority of the quorum.
No Member shall be entitled to vote at such meetings unless they are
financial at the time of such meetings.
The President shall, when presiding at Annual, Special and Management
Committee meetings have a deliberate and cast vote and have unlimited
authority on every question of order.
The Chairman of an Annual, Special or Management Committee meeting other
that the President or the Chairman of any sub-committee shall have a
casting vote only when presiding and have unlimited authority on every
question of order.
CLAUSE 12 - INTERPRETATION
In the event of anything occurring not within the scope of the following
Constitution, or the State or National Constitution the Management
Committee may deal with the same at their discretion and as they see fit
and their decision shall be binding upon the Club.
The Management Committee shall be the sole authority for the
interpretation of the Constitution
CLAUSE 13 - INDEMNITY
The members of the Committee and other Officers of the Club and their
respective heirs, executors and administrators and assigns shall be
indemnified and saved harmless out of fund of the Club from and against
all charges, costs, losses, damages and expenses which they or any of
them shall or may incur or sustain in or about the execution of their
respective offices or in or about any contracts or agreements made by
them for or on behalf of the Club or in the furtherance of the objects
of the Club except such charges or expenses as shall be incurred or
sustained through their own wilful default and none of them shall be
answerable for the others of them nor for joining in any receipt for the
sake of conformity only, nor for any banker, broker or other person with
whom monies or effects belonging to the Club shall or may be lodged for
safe custody sale investment or otherwise nor for the sufficiency of any
security on which any monies belonging to the Club may be placed out or
invested nor any other misfortune.
Loss or damage which may happen in the execution of their respective
officers or in any way in relation thereto, except the same shall happen
by or though their own wilful default respectively and no committee
person or officer of the Club shall be liable to repay any money which
he did not personally receive and misappropriate.
CLAUSE 14 - ALTERATIONS TO THE CONSTITUTION AND BY-LAWS
No alterations of the Constitution shall be made except at an Annual
General Meeting or a Special General Meeting called for that purpose,
fourteen (14) days notice of such proposed alterations to be given in
writing to the Secretary.
A copy of any additions or alterations and particulars of any deletions
shall be filed with the relevant State Controlling Body within twenty
eight (28) days after the meeting.
Provision/alteration of Club BY-LAWS may be made at any Management
Committee meeting providing seven (7) days notice in writing of such
amendments is given to the Secretary.
CLAUSE 15 - WINDING UP
No resolution for the winding up of the Club shall be deemed to have
passed unless a notice to propose a resolution to that effect at a
Special General Meeting shall have been given to the members thirty (30)
days prior to such meeting, and unless such proposition shall have been
carried at such meeting by at least seventy five (75%) percent majority
of those voting at that meeting.
No person shall be entitled to participate in any winding up except
those who are financial members at the date of the passing of such
resolution as afore-said.
On winding up, the property and assets of the Club will revert to the
State Centre.
BY-LAWS
BY-LAW 1 - CARE AND USE OF THE CLUB HOUSE AND PROPERTY
(a) The Clubhouse shall be available for bonafide members of the Club
for such purpose as may be determined by the Management Committee.
(b) Each Club Officer pursuant to clause eight (8) of the constitution
may be issued with keys to the Clubrooms, provided that the Management
Committee deems the issue is warranted and the following conditions are
agreed to:-
(i) The key is issued for the current season only and shall be returned
to the Secretary at or before the Annual General Meeting.
(ii) No copies may be made of the keys.
(iii) Keys shall be returned to the Secretary forthwith upon resignation
or retirement from office.
(iv) In the case of lost keys replacement will be affected at the cost
of the offending officer.
(v) Keys shall be issued to one (1) Member only for one (1) purpose
only, are not transferable and shall be returned at the completion of
the said purpose.
Members resigning or retiring from the Club shall return keys forthwith.
A duplicate key of all locks of the Club shall be kept by the Secretary
who will be responsible for the same.
(c) It shall be the duty of the patrol on Sunday to clean the Clubhouse.
Members shall use their individual efforts to preserve the cleanliness
of the Clubhouse.
(d) The Clubhouse shall be available for drill or other purposes
connected with the work of the Club at such times as may be required by
the Captain, Vice Captain or Chief Instructor. No form of games or
amusements shall be permitted while such drill is in progress.
(e) Games liable to damage Club property shall be prohibited.
(f) Climbing on the roof of the Clubhouse or other part of the building
except for maintenance reasons is prohibited.
(g) (i) No gear or Club property shall be removed from the Clubhouse
without the approval of the Management Committee, who shall only grant
permission upon the member becoming a guarantor for its safe return.
(ii) (a) That all craft kept in the Clubrooms be clearly marked to
indicate the ownership thereof, and the owner must be a registered
Member of the Club.
(b) All registered Members who wish to house their own equipment within
the Clubrooms are to apply to the Secretary and specify their reasons.
(c) All personal/private equipment or property left or stored within or
without the Clubrooms is done so entirely at the owner’s own risk.
(h) No question of party, municipal, political or religion principles
shall be discussed at any meeting of the Club nor shall the Club
premises be used for any such purpose.
(i) Any person visiting the Club shall be asked to sign the Visitors
Book kept in the bar area.
BY-LAWS 2 - CONDUCT
(a) No intoxicating liquor/drug shall be bought into the Clubhouse or
boat shed without permission of the Management Committee.
(b) No unseemly conduct likely to interfere with the comfort of other
members/visitors of the Club shall be permitted and members shall assist
in preventing such conduct.
(c) Expectoration and use of bad language is prohibited.
(d) The membership of any member who is proved guilty of disorderly or
infamous conduct in any public place will be dealt with by the
Management Committee.
(e) No smoking will be allowed including Clubrooms, boat shed and patrol
areas.
BY-LAWS 3 - COMPETITION CONDITIONS
(a) Members entered with their permission by the Club in any intra club
competitions, who fail to compete, shall furnish a satisfactory
explanation of such failure to the Selection Committee upon request by
said Committee.
Any member failing to do so shall be dealt with by the Management
Committee.
(b) Complete conditions of competition, together with description of
trophies/prizes etc for same shall be exhibited on the club notice board
at least fourteen (14) days prior to the commencement of such
competition.
All water events conducted on a point score basis and team competitions
shall conclude not later than the last Sunday in April, in each year
unless the time is specifically extended by the Management Committee.
BY-LAWS 4 - MEMBERSHIP
(1) The annual subscription shall be determined at the Annual General
Meeting by the voting members present and the members of the Club shall
be required to pay such fees.
Subscriptions are due before the first (1st) day in December in the same
year and be submitted with the appropriate membership/renewal forms,
otherwise members will be liable to suspension until the membership is
paid.
(2) Conditions of entry in Association competitions shall be laid down
in the relevant Association manuals/handbooks.
BY-LAWS 5 - RENEWAL OF MEMBERSHIP
Membership may be renewed annually upon application and payment of the
prescribed subscription fees. The Committee may refuse to renew the
membership of any member or ex-member, but such persons shall have the
right of appeal addressed in writing to the Secretary, to a decision of
a special general meeting called for the purpose.
BY-LAW 6 - NEW MEMBERSHIP
Every Candidate for membership shall be nominated by one (1) financial
member and seconded by another, both of whom shall be personally known
to the candidate, in such form as shall be prescribed by the committee.
The nomination shall be lodged, together with the appropriate entrance
fee, with the Secretary.
The application shall be considered by the Committee at its next
meeting.
BY-LAW 7 - DUTIES OF OFFICERS
President:
The President shall preside at all annual, special, management and
executive meetings of the Club.
The President shall maintain order and see that the duties of the other
officers are properly performed.
After ratification, the President shall sign as a true and correct
record, the minutes of annual, special, management and executive
meetings.
The President ex-officio member of all subcommittees except the
discipline committee
Vice President:
The Vice President shall assist the President in the performance of his
duties as may be required and shall deputise for him in his absence and
shall be the Chairman of Disciplinary Committee.
Secretary:
The Secretary shall attend all Management Meetings of the Club, keep all
minutes, conduct the correspondence of the Club and take charge of all
papers.
The Secretary shall be responsible for exhibiting all instructions and
notices.
The Secretary shall forward notice of all meetings and the business to
be conducted there to members as required by the Constitution or as may
be directed by the Committee.
The Secretary shall be responsible for the Annual Report.
The Secretary shall keep a record of all members and officers of the
Club and shall cause to be kept all details of awards, competition
results, patrol hours and any other surf lifesaving activities of such
members.
The Secretary shall arrange registration and insurance of all members as
required by the State Center.
He shall submit a report at each meeting of the Management Committee
Treasurer:
The Treasurer shall:-
(1) Nominally be responsible to the Club for control of, advise of cash
flow and of finance general.
(2) Be concerned with fundraising to ensure that the Club can fulfil its
program of projects.
(3) Ensure that correct auditing and controls are maintained at any
level of the Clubs receivable income.
(4) Be responsible for presentation to each meeting of the Committee of
a financial statement and an account of the finances, accompanied by the
bank statement and reconciliation of the statement with the cash book,
and in addition a statement showing status of each separate fund which
is held for accounting convenience. Such statements shall be circulated
with minutes of the meeting.
(5) Be responsible for presentation of the audit of an annual balance
sheet and statement of accounts. Such balance sheet shall, when duly
certified by the Auditor, be presented to the Annual General Meeting or
prior thereto.
(6) If directed by the Committee shall prepare a summary of the
financial situation of the Club, especially those areas that may be
showing concern and in need of assistance.
(7) Be the Chairman of any finance or budget committee that may be
formed from time to time by the Committee.
(8) He Shall submit a report at each meeting of the Management Committee
Captain:
The Club Captain shall:-
(1) Hold a Bronze Medallion and be responsible for all surf lifesaving
activities performed by members of the Club.
(2) He shall, with the Vice Captain, select and place all financial
members (with the appropriate awards) into rostered patrols for the
season.
(3) He shall submit a report at each meeting of the Committee.
Vice Captain:
The Vice Captain:-
(1) He shall hold a Bronze Medallion and be responsible for the
efficiency of the patrols and shall, in conjunction with the Secretary,
submit to the State Centre such details as may from time to time be
required.
(2) He shall assist the Club Captain in the performance of his duties as
may be required and shall deputies for him in his absence.
(3) He shall submit a report at each meeting of the Committee pertaining
to the performance of all patrols.
Chief Instructor:
The Chief Instructor shall :-
(1) Hold the Bronze Medallion and the Training Officers Certificate.
(2) Co-ordinate the formulation of members into squads for training and
instruction for the examination for the appropriate awards under
competent instructors.
(3) Arrange such other instruction for members as considered necessary
for their overall betterment and/or the gaining of additional S.L.S.A.A.
awards.
(4) He shall submit a report at each meeting of the Committee.
Competition & Coaching Co-ordinator:
The Competition & Coaching Co-ordinator shall be responsible for the
following:-
(1) Development competition
(2) Development instruction and management of all coaching
(3) Board & Ski Acquisition recommendations
(4) Attendance at Board & Ski meetings
(5) Shall submit a report at the Management Committee Meetings
Skills recommended:-
(1) Bronze Medallion
(2) Level 1 Surf Coach
(3) Gym Instructor
Social Business Co-ordinator :-
Social Business Co-ordinator shall be responsible for the following:-
(1) House Management
(2) Bar Management
(3) Promotions
(4) Catering
(5) Social Functions
(6) submit a report at Management Committee Meetings
Skills Recommended:-
(1) High level of communication skills
Junior Division Manager
The Junior Division Manager shall:-
(1) Be responsible for the administration and control of all activities
pertaining to those members whose age is under fourteen (14) years.
(2) He shall submit a report at each meeting of the Management Committee
Under 19 Delegate
The Under 19 Delegate shall:-
(1) be responsible for the well being and interests of those members
between the ages of fourteen (14) and under nineteen (19) years.
(2) He shall submit a report at the meeting of the Management Committee
Occupational Health and Safety Officer:-
The Occupational Health and Safety Officer shall: -
(1) be responsible for administering the Health & Safety Policy of the
club
(2) He shall submit a report at the meeting of the Management Committee
Boat Captain:
The Boat Captain shall:-
(1) be responsible for the maintenance and care of the Clubs surf boats
and associated equipment, and shall act under the direction of the Club
Captain.
(2) He shall submit a report as necessary via the Club Captain to
meetings of the Management Committee
I.R.B Captain:
The I.R.B Captain shall:-
(1) Under direction of the Club Captain and Chief Instructor shall
arrange instruction for suitable members in all phases of I.R.B work as
described in the relevant S.L.S.A.A manuals and handbooks, and be
responsible for the care and maintenance of the Clubs I.R.B’s motors and
accessories.
(2) The I.R.B Captain must hold an I.R.B Instructors Certificate.
(3) He shall liaise with the Competition & Coaching Co-ordinator in
regard to competition & training
(4) He shall submit a report as necessary via the Club Captain to
meetings of the Management Committee.
Board & Ski Captain:
The Board & Ski Captain shall be responsible for the following:-
(1) Maintenance and care of club boards and ski`s
(2) Assist with coaching of said craft for suitable members
(3) Assist with Board & Ski Acquisition recommendations
(4) Maintenance of club board & ski storage
(5) Be responsible to the Competition & Coaching Co-ordinator
Skills Recommended:-
(1) Knowledge of board repairs
(2) Level 1 Surf Coach
(3) Hold a Bronze Medallion
House Manager
The House Manager shall be responsible to the Social Business
Co-ordinator for the maintenance care cleaning & hire of all relevant
equipment involved in the Social activities of the club.
All monies arising out of the use and hire of the relevant equipment
shall be balanced and delivered to the Treasurer
He shall liaise with the caterer, maintenances officer and caretaker as
required
He shall submit a report as necessary via the Social Business
Co-ordinator to meetings of the Management Committee.
Promotions Officer
The Promotions Officer shall:-
(1) be responsible to the Social Business Co0ordinator and will endeavor
to advance the interests of the Club by bringing the activities of the
Club before the notice of the public.
(2) In the event of any controversial or detrimental publicity he shall
act only at the direction of the Committee.
(3) He shall be responsible to the Committee for the implementation of
appropriate recruiting campaigns as from time to time are deemed
necessary
(4) He shall submit a report as necessary via the Social Business
Co-ordinator to meetings of the Management Committee.
Fund Raising Officer
The Fund Raising Officer shall:-
(1) Be responsible to the Social Business Co-ordinator for the
co-ordination, conduct and arrangement of all social fundraising
activities conducted by, or on behalf of the Club, whether within the
Club or not.
(2) He may form such Committees to assist in fund raising as he deems
necessary.
(3) He shall submit a report as necessary via the Social Business
Co-ordinator to meetings of the Management Committee.
Gear Steward
The Gear Steward shall:-
(1) Be responsible to the Club Captain for the upkeep and maintenance of
all Patrol lifesaving gear and equipment with the exception of the
I.R.B’s, vehicles and trailers.
(2) He shall submit a report as necessary via the Club Captain to
meetings of the Management Committee.
Maintenance Officer
The Maintenance Officer shall:-
(1) be responsible for the upkeep and maintenance of the building (s) in
general as per the Maintenance Schedule
(2) He shall submit a report as necessary via the Social Business
Co-ordinator to meetings of the Management Committee.
Caretaker
The Caretaker shall be responsible to the House Manager
First Aid Officer
The First Aid Officer shall:-
(1) hold a First Aid Certificate or be trained in First Aid.
(2) He shall be responsible for the maintainance and upgrading of first
aid policies and equipment.
(3) He shall submit a report as necessary via the Club Captain to
meetings of the Management Committee.
Radio Officer
The Radio Officer shall:-
(1) Act under the direction of the Club Captain and shall be responsible
for the care and maintenance of all thee Clubs radios and related
equipment.
(2) He shall submit a report as necessary via the Club Captain to
meetings of the Management Committee.
Sponsorship Officer:-
The Sponsorship Officer shall:-
(1) Be responsible to the Social Business Co-ordinator for the
co-ordination conduct & arrangement of all Sponsorship on behalf of the
club
(2) He shall be charged with the responsibility of seeking financial or
otherwise assistance by way of sponsorship for the club
(3) He shall submit a report as necessary via the Social Business
Co-ordinator to meetings of the Management Committee.
Apparel Officer
The Apparel Officer shall:-
(1) Be responsible to the Club Captain for the procurement, sale and
supply of all apparel requirements of the Club and its members.
(2) All monies acquired through sale of apparel shall be balanced and
passed onto the Treasurer forthwith.
(3) He shall submit a report as necessary via the Club Captain to
meetings of the Management Committee.
.Vehicle Officer
The Vehicle Officer shall:-
(1) under the direction of the Club Captain be responsible for the care
and maintenance of the clubs mobile rescue vehicles and trailers and
shall ensure that the mobile vehicles are fuelled and ready for
immediate use.
(2) Provide a program of instruction suitable for proficiencies of the
four wheel drive operation
(3) He shall submit a report on the condition of the equipment under his
control to the Club Captain as necessary
Bar Manager:-
The Bar Manager shall:-
(1) Be responsible to the Management Committee for the maintenance,
care, cleaning and operation and control of the bar.
(2) All monies arising out of the use and hire of the relevant equipment
be balanced and delivered to the Treasurer
(3) He shall submit a report to the management Committee as necessary
Catering Officer
The Catering Officer shall be responsible to the House Manager
Assistant Junior Division Manager
Assistant Junior Division Manager shall be responsible to the Junior
Manager
Social Committee Co-ordinator
Social Committee Co-ordinator shall:-
(1) Be responsible to the Fundraising Officer
(2) Responsible for Social and fun activities
(3) Submit a report via the Social Business Co-ordinator as necessary
Coaches
Coaches shall be responsible to the Competition and Coaching
Co-ordinator
Patrol Captains
Patrol Captains shall be responsible to the Vice Captain
Vehicle Drivers
Vehicle Drivers shall be proficient in driving the clubs four wheel
drive and trailers and have no license restrictions
Auditor:
It shall be the duty of the Auditor to audit books and accounts prepared
by the Treasurer for submission at the Annual General Meeting and to
certify the correctness thereof. The auditor shall be suitably qualified
to carry out this function.
Medical Officer
The Medical Officer shall be a medical practitioner and shall render
such medical advice and assistance as may be required by the committee
from time to time.
The Medical Officer shall be appointed by the Management Committee.
Legal Adviser
The Honorary Legal Adviser shall be a legal solicitor and shall render
legal advise and assistance as may be required by the committee from
time to time.
The Legal Adviser shall be appointed by the Management Committee
BY-LAWS 8 - ELECTIONS OF OFFICERS
(a) Twelve (12) person Management Committee shall be elected at the
Annual General Meeting at which all General and Life Members shall be
entitled to vote.
(b) All club Representatives, Elected Officers, and Sub Committee
Representatives to be members at the time of election, or within 14 days
of appointment, and for the duration of their term
All other officers may be elected at the Annual General Meeting,
positions not filled to be elected by the Management Committee at its
first meeting.
BY-LAW 9 - STANDING SUB COMMITTEES
(1) Executive Committee:
The Executive Committee shall consist of:-
President
Vice President
Secretary
Treasurer
Club Captain
three (3) of whom shall form a quorum which shall have the power to deal
with all urgent matters and shall report their actions to the next
Management Committee meeting held thereafter.
(2) Junior Activities Committee:
The Junior Activities Committee shall under thee direction of the Junior
Manager be formed annually from persons interested in the well being of
members whose ages range from seven (7) to under fourteen (14) years and
shall be chaired by the Junior manger.
The Junior Activities Committee shall elect from amongst themselves a
Secretary, Treasurer and such other office bearers as considered
necessary.
Seventy Five (75%) per cent of the Junior Activities Committee shall
form a quorum.
All monies arising from junior activities (in excess of the float) shall
be balanced and delivered to the Treasurer monthly.
An income and expenditure statement for each financial year is to be
submitted to the Secretary for presentation in the Annual Report.
(3) Disciplinary Committee:
The Disciplinary Committee shall comprise the:-
Vice President
Club Captain
*Life Member
*Two other Members
*To be elected by the management committee.
Five (5) shall form a quorum.
The Disciplinary Committee may expel, or for a period suspend or
reprimand and/or penalise any member who violates a rule of the Club or
shall be guilty of misconduct, breach of discipline or act contrary to
the general policy of the Club, provided that such member shall have the
opportunity to state his case either personally or through another
member to the Disciplinary Committee before it arrives at its decision.
The Disciplinary Committee shall forthwith report its findings and
determinations in writing to the Management Committee.
The member effected by the findings and determinations of the
Disciplinary Committee shall have the right of appeal against such
findings and determinations to the Management Committee and the
following provisions shall apply:
(1) The member shall within fourteen (14) days of findings and
determinations of the Disciplinary Committee inform the secretary in
writing of the grounds of such appeal.
(2) The Secretary shall forthwith convene a meeting of the Management
Committee to hear and determine the appeal of the member against the
findings and determinations of the Disciplinary Committee.
(3) At such hearing the member may appear personally or through another
member.
(4) The Management Committee shall hear and determine the appeal.
(5) The Appeal - Should the determination of the Management Committee
not be acceptable the member has a second right of appeal to the next
highest authority that being the State Body.

(4) Life Membership Committee:
The Life Membership Committee shall consist of three (3) life members
and two (2) other members.
The three life members will be elected at the Annual General Meeting and
the two (2) other members shall be appointed by the Management
Committee.
The Management Committee shall appoint a Chairman.
The Life Membership Committee shall meet at least one (1) month prior to
the annual presentations to consider such nominations as may be received
and to review all members who may be eligible in terms of clause 6. Five
(5) shall form a quorum.
(5) Constitution Committee:
The Constitution Committee shall comprise of three (3) members all of
whom shall be appointed by the Management Committee.
The Constitution Committee shall be responsible to the Management
Committee to deal with all matters relating to the Constitution that may
be referred to it for report and recommendations to the Management
Committee.
BY-LAW 10 - ANNUAL GENERAL MEETING
The Annual General Meeting shall be held during June to receive the
Annual Report and Audited Financial Statement, to elect the Management
Committee and other Committee members as provided for in the
Constitution for the ensuing season, to consider notices of motion set
annual subscriptions/fees and transact general business.
Seven (7) days notice in writing shall be given for the meeting. Twenty
five (25%) percent of persons entitled to vote pursuant to clause 11
shall form a quorum.
Should a quorum not be obtained the meeting shall stand adjourned until
a date to be fixed by the Executive by the Management Committee.
BY-LAW 11 - SPECIAL GENERAL MEETING
A Special General Meeting may be called in fourteen (14) days upon
request in writing to the Secretary from at least eight (8) members of
the Club.
A General Meeting may be called by the Management Committee at anytime.
Seven (7) days notice must be given, stating the business to be
discussed.
Forty (40%) per cent of persons entitled to vote at the meeting pursuant
to clause 11 shall form a quorum.
No other business shall be taken.
Should there not be a quorum present thirty (30) minutes after the time
for which the meeting was called, the meeting shall lapse.
BY-LAW 12 - VISITORS TO THE CLUB
(1) Every adult member shall be allowed to introduce visitors to the
Club subject to such regulations as the Committee shall from time to
time determine, provided that no person shall be introduced as a visitor
who has been expelled from membership of a surf lifesaving club or whose
conduct or presence on the clubs premises shall be considered
objectionable to the interests of the Club.
(2) Each Life, General Member of the Club may, on any day introduce up
to three (3) visitors to the clubs premises, or such lesser number as
may be fixed by the licensing authority.
Liquor must not be supplied to a visitor unless the visitor is in the
company of a member who has entered the name of the visitor in a book
kept for the purpose and has signed his name opposite the name of the
visitor.
BY-LAW 13 - PATROLS
Members shall attend at the beach for patrol duty on such dates and at
such hours as may be specified by the Captain/Committee in the Patrol
Roster or as directed by the State Centre.
Each member shall be personally responsible that he acquaints himself
with such dates and hours and the number of his patrol from the Patrol
Roster.
Any member who is unable to attend his patrol shall find a substitute.
Notwithstanding anything contained in preceding paragraphs of these
rules, the Management Committee may indicate to any member in writing
that in their opinion he is not giving satisfactory patrol service and
call upon him for an explanation.
Any member who has been granted exemption for patrol at his own request
may be called upon to make good such patrol either in that season for
the following one.
Failure to comply shall render him liable to be dealt with by the
Committee.
Patrol Captains are responsible for members of their patrol signing the
Patrol Sheet and the notation there on of irregularities, rescues
performed etc. The Patrol Captain shall also see that his members have
knowledge of such State Centre obligations as are necessary.
Any member missing two (2) patrols during any one (1) season is liable
to suspension.
All members upon entering the Club premises automatically become liable
to carry out a patrol if requested by a person with necessary authority.
Exemption from patrols may be granted in exceptional circumstances, or
to members and /or senior club officers whose duties may warrant such
exemption.
BY-LAW 14 - SEAL AND SEAL HOLDER
The Club shall have a common Seal to be kept in the custody of the
Secretary. It shall never be used except by authority of the Committee.
Every instrument to which the seal is affixed shall be countersigned by
the President (or in his absence the Vice President) and by the
Secretary/Public Officer.
BY-LAW 15 - PUBLIC OFFICER
The Public Officer of the Club shall be the Secretary or (subject to the
provisions of statute from time to time existing) such other person who
may be nominated by the Management Committee of the Club.
The Public Officer shall supply the State Business and Corporate Affairs
Office with particulars of his name, address and occupation.
Any changes to the Public Officers appointment hall be conveyed to the
State Business and Corporate Affairs Office within fourteen (14) days.
BY-LAW 16 - PATROL ACTIVITIES
(i) General Patrol Activity.
In order to participate in general patrol activity a member will:-
(a) If between the ages of thirteen (13) and fifteen (15) years have
gained the Surf Life Saving Certificate accreditation in that season or
have passed the annual Association Proficiency requirement for that
award.
(b) If over the age of fifteen (15) years have gained the Surf
Lifesaving Bronze Medallion accreditation for that season, or have
passed the annual Association Proficiency requirement for that award.
(ii) Ancillary Patrol Activity.
In order to participate in ancillary patrol activity a member will:-
(a) Be of the age as defined in the Association Manuals who has gained
Radio, Resuscitation, Advanced Resuscitation or First Aid accreditation
and be current as required by the Association in that discipline.
(b) Members in this category may only participate in activity pertaining
to the scope of the said accreditation requirement.
BY-LAW 17 - COMPETITION ACCREDITATION
In order to participate in competition activity a member will:-
(a) If between the ages of seven (7) and thirteen (13) years, be
accredited for their age group as identified in the Association Junior
Activities Manuals.
(b) If between the ages of thirteen (13) and fifteen (15) years be
accredited with the Association Surf Life Saving Certificate in that
season, or be the holder of the Association Surf Life Saving Certificate
and have passed the annual Association proficiency requirement for that
award.
(c) If over fifteen (15) years of age be accredited with the Association
Bronze Medallion in that season, or be the holder of the Association
Bronze Medallion and have passed the annual association Proficiency
requirement for that award.
(i) Not be in default or arrears of patrol duties in excess of those
allowed by the Club Constitution for which the member is competing or in
excess of ten (10) hours, whichever is the least.
(ii) In the case of having completed eight (8) years of satisfactory
patrol and Club obligations as provided by thee Association and Club
Constitution and By-Laws, since the gaining of the Bronze Medallion, and
such service recognised by resolution of thee appropriate Club body, be
required to perform a minimum of patrol hours as required by the
Association.
(iii) In the case of having completed ten (10) years of patrol and Club
obligations as provided by the Association and Club Constitution and
By-Laws, since the gaining of the Association Bronze Medallion, or eight
(8) years of patrol and Club obligations as in (c) (i) and four (4)
years of patrol and Club obligations as in (c) (ii), and such service is
recognised by resolution of the appropriate Club body, be granted
exemption from all patrol obligations.
(d) An additional requirement in thee case of State Championships
competition participation is that the member shall be accredited with
minimum personal patrol hour requirement for that season.
(e) Life Members shall be accredited with the Association Bronze
Medallion in that season, or be the holder of the Association Bronze
Medallion and have passed the annual Association Proficiency requirement
for that award and in the case of State Championships competition
participation the member shall be required to carry out his required
number of personal patrol hours.
BY-LAW 18 - BOARD AND SKI ACQUISITION PROGRAMME
Selection panel for this Programme shall comprise:-
Ski Captain
Board Captain
Water Captain
Beach Captain
Boat Captain
Plus the Club Executive
Any three (3) members shall form a quorum provided that two (2) members
are part of the executive.
They shall make suggestions to the Management Committee regarding
suitability of applicants for this Programme but do not have the power
to invoke its use.
